OPERATIONAL COMMAND AGREEMENT

1. MISSION ELIGIBILITY (SERVICE ACCESS)

• Age Requirement: You must be at least 18 years old (or the age of majority in your jurisdiction) to purchase tactical gear, medical devices, or create an account. Minors may browse under parental supervision, but all transactions require adult authorization.
• Geographic Restrictions: We currently ship to most countries, but some regions restrict tactical/medical gear imports. You are responsible for complying with local laws—we reserve the right to cancel orders violating these restrictions.
• Account Security: If you create an account, you are responsible for safeguarding login credentials and all activity under your account. Notify Support@Qirexynor.com immediately of unauthorized access.

2. GEAR ACQUISITION PROTOCOL (PURCHASE TERMS)

• Product Availability: All gear is subject to availability. We may limit order quantities, discontinue products, or reject orders at our discretion (e.g., suspected fraud, pricing errors).
• Pricing & Payment: Prices are listed in USD and do not include taxes or shipping fees (calculated at checkout). We accept major credit cards and PayPal—payment must clear before deployment.
• Order Confirmation: An "Order Received" email confirms we’ve received your request, but does not guarantee acceptance. A separate "Shipping Confirmation" indicates order fulfillment.
• Pricing Errors: If a product is listed at an incorrect price due to typographical or system errors, we may cancel your order and refund the full amount—even after shipping.

3. OPERATOR CODE OF CONDUCT (USER RESPONSIBILITIES)

• Lawful Use: Do not use our site for illegal purposes (e.g., hacking, distributing malware, violating export controls).
• Accurate Intel: Provide truthful, current information (e.g., contact details, shipping addresses) during purchases or account registration.
• Respect Intellectual Property: Do not reproduce, distribute, or exploit Qirexynor trademarks, logos, product designs, or content without written permission.
• Prohibited Actions: Do not reverse-engineer gear, tamper with safety features, or use products in ways not intended (e.g., using a tourniquet as a restraint device).

4. INTELLECTUAL PROPERTY RIGHTS (OUR ASSETS)

• View, download, and print content for personal, non-commercial use (e.g., reviewing product specs).
• Not: Modify, copy, or redistribute content for commercial gain, or remove proprietary notices (e.g., © Qirexynor 2026).
• Product Designs: Our patent-pending Qen Tourniquet and IFAK configurations are protected by U.S. and international intellectual property laws. Unauthorized replication is prohibited.

5. MEDICAL DISCLAIMER (CRITICAL SAFETY NOTICE)

• Training Required: Proper use requires training (e.g., Stop the Bleed courses). We strongly recommend professional instruction before deploying gear in emergencies.
• Not a Substitute for Professionals: Our products do not replace emergency medical services (EMS). Always call 911/your local emergency number after applying gear.
• Assumption of Risk: You acknowledge that using tactical/medical gear involves inherent risks (e.g., tissue damage from prolonged tourniquet use). Qirexynor is not liable for injuries resulting from improper use, lack of training, or delayed medical care.
• No Medical Advice: Content on our site (blogs, videos, FAQs) is for informational purposes only—not medical advice. Consult a healthcare provider for medical guidance.

6. LIMITATION OF LIABILITY (WAIVER OF CLAIMS)

• Indirect Damages: Qirexynor shall not be liable for indirect, incidental, punitive, or consequential damages (e.g., lost profits, emotional distress, bodily injury) arising from gear use, site access, or inability to use our services.
• Direct Damages Cap: Our total liability for any claim shall not exceed the purchase price of the product(s) giving rise to the claim.
• Exceptions: Nothing in these Terms limits liability for gross negligence, willful misconduct, or violations of mandatory consumer protection laws (e.g., product liability for manufacturing defects).

7. INDEMNIFICATION (PROTECTING OUR OPERATIONS)

• Your violation of these Terms.
• Improper use of our gear (e.g., untrained deployment, ignoring medical disclaimers).
• Your negligence or willful misconduct.
• Infringement of third-party rights (e.g., using our products to harm others).

8. DISPUTE RESOLUTION (CONFLICT PROTOCOL)

• Governing Law: These Terms are governed by the laws of the State of Delaware, USA, without regard to conflict of law principles.
• Informal Resolution: Before filing a claim, contact Support@Qirexynor.com to attempt informal resolution—we aim to resolve disputes within 30 days.
• Arbitration: Any unresolved dispute shall be settled by binding arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules. Arbitration will occur in Delaware, USA, in English.
• Class Action Waiver: You waive the right to participate in class actions, class arbitrations, or consolidated proceedings against Qirexynor.
• Injunctive Relief: Notwithstanding the above, we may seek injunctive or equitable relief in state or federal courts to protect intellectual property or prevent irreparable harm.

9. MODIFICATIONS & TERMINATION

• Terms Updates: We may update these Terms periodically (e.g., legal changes, operational adjustments). The "Last Updated" date below reflects revisions. Continued site use after changes constitutes acceptance.
• Service Termination: We reserve the right to suspend or terminate your account/site access at our discretion (e.g., violating Terms, fraudulent activity) without prior notice.
